Parfum Avenue Creator Program Terms

1. Acceptance

By applying to, participating in, or accepting any collaboration opportunity through the Parfum Avenue Creator Program, you agree to these Terms.

By submitting an application or accepting any product, affiliate link, discount code, or collaboration opportunity from Parfum Avenue, you acknowledge and agree to these Terms.

Participation in the program is voluntary.

2. Collaboration Opportunities

Parfum Avenue may offer approved creators one or more of the following:

  • Affiliate partnerships
  • Product gifting opportunities
  • Campaign-based collaborations
  • Paid collaborations

Participation in the Creator Program does not guarantee product gifting, compensation, or future collaboration opportunities.

3. Creator Deliverables

Where requested by Parfum Avenue, creators agree to provide:

  • 1 short-form video published on Instagram Reels and TikTok
  • 3 Instagram Story frames containing the creator’s affiliate link or discount code where technically possible
  • Original content files

Specific campaign requirements may be communicated separately and shall form part of these Terms.

Creators agree to publish requested content within 14 days of receiving the product unless otherwise agreed in writing.

Creators agree to provide original content files to Parfum Avenue within 7 days of publication.

Failure to provide requested deliverables may result in removal from the Creator Program, cancellation of affiliate benefits, forfeiture of future collaboration opportunities, and suspension from any Parfum Avenue creator initiatives.

Where products are provided specifically in exchange for agreed deliverables, and such deliverables are not provided within the agreed timeframe without reasonable cause, Parfum Avenue reserves the right to seek reimbursement of the product value to the extent permitted by applicable law.

4. Content Standards

Creators agree to:

  • Represent products honestly and accurately
  • Comply with all applicable advertising, disclosure, and platform requirements
  • Avoid misleading, deceptive, or false claims
  • Maintain content that is consistent with Parfum Avenue’s brand image

Parfum Avenue reserves the right to reject content that does not meet these standards.

If requested by Parfum Avenue, creators agree to remove, update, or correct content that contains inaccurate information, pricing errors, expired promotions, or regulatory concerns.

5. Affiliate Program

Approved creators may receive a unique affiliate link and/or discount code.

Commission rates, eligibility requirements, and payment schedules may be modified at any time at Parfum Avenue’s discretion.

Fraudulent activity, self-referrals, misleading promotions, or attempts to manipulate affiliate tracking may result in immediate removal from the program and forfeiture of unpaid commissions.

6. Content License

The creator retains ownership of all content created.

However, by participating in the Creator Program and submitting content to Parfum Avenue, the creator grants Parfum Avenue a perpetual, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to:

  • Use
  • Reproduce
  • Edit
  • Modify
  • Publish
  • Display
  • Distribute
  • Repurpose

the content in any format and on any platform.

This includes, without limitation:

  • Instagram
  • Facebook
  • TikTok
  • YouTube
  • Pinterest
  • LinkedIn
  • Website content
  • Product pages
  • Landing pages
  • Blog articles
  • Email marketing
  • SMS marketing
  • Organic social media content
  • Paid advertising campaigns
  • Meta Ads
  • TikTok Ads
  • Google Ads
  • YouTube Ads
  • Display advertising
  • Future advertising platforms

The creator acknowledges that Parfum Avenue may crop, resize, caption, edit, combine, or otherwise adapt the content for marketing purposes.

No additional compensation shall be due for such usage unless otherwise agreed in writing.

Parfum Avenue is under no obligation to publish, repost, use, promote, or advertise any creator content submitted through the Creator Program.

7. Intellectual Property

Creators represent that:

  • They own the content submitted
  • They have all necessary rights to grant the license described in these Terms
  • Their content does not infringe upon any third-party intellectual property rights

Creators remain solely responsible for music, images, trademarks, or other third-party content used within their content.

8. Program Removal

Parfum Avenue may approve, reject, suspend, or remove any creator from the program at its sole discretion and without prior notice.

9. Limitation of Liability

Parfum Avenue shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from participation in the Creator Program.

To the maximum extent permitted by law, Parfum Avenue’s total liability arising from or relating to the Creator Program shall not exceed the value of any commissions or products provided to the creator during the twelve (12) months preceding the claim.

10. Changes to These Terms

Parfum Avenue may update these Terms at any time.

Updated Terms will become effective upon publication on the Parfum Avenue website or communication to creators through reasonable means.

Continued participation in the Creator Program constitutes acceptance of any updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia.

Any dispute arising out of or relating to the Creator Program or these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable Australian consumer laws.
